House committee on justice chairman Reynaldo Umali on Monday denied saying that a recently concluded congressional probe found no evidence to link Senator Leila de Lima to an alleged narcotics syndicate in the New Bilibid Prison.





The Manila Standard on Sunday quoted Umali as saying that the investigation he led had failed to establish De Lima's liability for the proliferation of drugs inside the national penitentiary when she was still Justice secretary.

Umali dismissed the report as "a spin of some members of the media or their way of sowing intrigue on the House of Representatives."

But he also stressed that recommending the filing of charges against De Lima is not the goal of their investigation.

"That is not our job. Prosecution is an executive function, not a congressional function. Investigation and enforcement are executive functions, not legislative functions... Our role is to legislate and that is what we will focus on our committee report, he said.

Despite this, Umali was also quick to note: "That is not to say that we will not have our own findings of what facts have been established in this committee."

During the four hearings of what Umali dubbed as the "most expeditious, swiftest, productive congressional inquiry", 22 witnesses and 10 resource persons/agencies testified that De Lima and several other ranking officials allegedly condoned the prison's drug trade in exchange for millions of pesos in grease money.

Congressmen on Monday held an executive session to deliberate on the draft report of their findings.

Under House rules, the contents of the draft cannot be made public until it is approved by the committee and scheduled for a plenary session, Umali said.

De Lima has refused to participate in the congressional inquiry, which she earlier dismissed as a "sham" orchestrated by President Duterte as retaliation for her criticism of the administration's brutal war on drugs.

Drug trafficking raps were lodged last week against De Lima and seven others in connection with the Bilibid controversy.

The Ombudsman will not conduct a motu propio investigation against Senator Leila de Lima.

Ombudsman Conchita Carpio-Morales said, all evidence thrown against Sen. de Lima are all still allegations.

“It’s not going to happen because all are still allegations. There is still no lead that will prompt us to initiate our investigation,” Morales said.

Morales added that they will start the investigation if there is a complaint filed against the senator.

Recently, the chief of police of Albuerra, Leyte filed a complaint against Sen. de lima at the Office of the Ombudsman-Visayas.

Morales said that all cases concerning high ranking officials must be forwarded to their office if it came from other regions. But the complaint has not reached their office.

Meanwhile, no case will be filed against the five PNP generals allegedly involved in drug trade until PNP is done with their own investigation.

“Not yet because the police people had been tasked to conduct their own investigation and it will be exercise in futility if, we, ourselves initiate. Because the facts will come from them,” said Morales.

The Ombudsman is currently conducting a lifestyle check on five PNP generals involved in the drug trade.

Five of the 12 witnesses presented before the House Committee on Justice inquiry have pending applications for pardon or executive clemency, the House minority bloc said Tuesday.


 


"I got this response from the Board of Pardons and Parole. I still maintain these witnesses are polluted witnesses as they were forced to testify because they're more concerned about their safety and comfort," Magdalo Rep. Gary Alejano said.

Alejano raised the possibility of freedom for Engelberto Durano, Nonilo Arile, Jaime Patcho, Jojo Baligad, and Vicente Sy following their unfavorable testimony against Senator Leila de Lima, who has been tagged by the administration as the protector of illegal drugs at the Bilibid.

The House probe centers on the proliferation of illegal drugs in the state penitentiary under De Lima's watch.

"Tinanong ko ito dahil pwedeng gamitin ito na regard sila nagtetestify sila binigyan ng immunity witness protection. Five out of the 12 anytime baka biglang lumaya ito," he said. [I'm asking this because they might be testifying just to get immunity. Five out of 12 might be suddenly released from jail.

Albay Rep. Edcel Lagman said, "Itong mga applications na ito for clemency or pardon will be enhanced by their cooperation in giving their testimonies. Durano's carpeta or case file was requested on October 27, 2015, Arile's was requested on 25 January 2011, Patcho's was returned to the Bureau of Corrections on 15 April 2016, Baligad's case is for verification of pending criminal cases per his record with the NBI while Sy's is for verification of other pending cases.

There are no records of pending applications for witnesses Rodolfo Magleo, Herbert Colangco, Noel Martinez, Froiln Trestiza, Hans Anton Tan, Jaybee Sebastian, and Peter Co.

Durano had testified: "Inabot ko na kay Secretary De Lima ang kahon na may lamang P1.5 million at sinabi 'Ma'am, ito no po.' Kinuha ito ni Secretary at inabot sa lalakeng sumalubong sa akin." [I handed a box containing P1.5 million to Secretary De Lima and told her, 'Here you go, ma'am.' She took the box and handed it over to the guy who greeted me.

Arile testified he was a police asset who discovered that De Lima is the protector of drugs operations. He also testified that some P300 million went missing from the Bilibid after an anti-illegal drugs operation was launched in December 2014.

Patcho, Baligad, and Sy were allegedly recruited to raise campaign funds for De Lima by selling drugs



House Justice Committee Chair Rey Umali said, "That is the call of the secretary of justice. Remember that this inmate witnesses were recommended for immunity by the SOJ and likewise on matters of parole that is the province of the SOJ who recommends to the president any of these initiatives that really should have to come from the SOJ.

"How the president will decide on the matter and this is a prerogative and a power of the president. It's the SOJ's call and the president's call we don't want to preempt," Umali said.

Umali said the committee is unaware of any quid pro quos for the testimony of the witnesses.

"We are unaware of that and if ever dapat siguro lumabas na yan kung meron. Wala naman kami nahihimigan na ganyan. that is a usual concern a minority group would always raise. The revelation came as the House Committee on Justice voted to approve its committee report on the investigation. The report can't be made public yet until it has been reported out in the House plenary.

The report doesn't cover the recent raid at the Bilibid, the testimony of Ronnie Dayan who remains at large, and the exclusion of the PNP from the anti-illegal drugs operation of December 2014 at the Bilibid. Those matters were referred to the subcommittee on corrections.

Umali said the committee has findings on the involvement and accountabilities of authorities.

Ako Bicol Party-list Rep. Alfredo Garbin however said after the vote, the minority will submit a dissenting opinion because the report makes no recommendation on the prosecution of those involved.

"The position of the minority is it is necessary to identify all those officials and personalities involved in the proliferation of drugs in NBP and a recommendation must be arrived on the prosecution of accountable officers and personalities in the prolifieration of drugs in the NBP. We find it conspicuously absent."

In an ambush interview, House Minority Leader Danilo Suarez pointed out that "there is no recommendation of what to do."

"We feel it's not fair considering the seriousness of the case the committee believes that the proliferation of this drug problem was because of the last six years when the SOJ could have done sizable amount of effort to curb its growth," Suarez said.

Suarez joined the call of Kabayan Party List Rep. Harry Roque for the ouster of De Lima as senator saying, "It's time for the senators to do something about their colleague. It is so glaring."

Lagman however rebutted Suarez and his group saying, "Thats the problem with the majority's minority leader. In the first place the Committee on Justice doesn't have the jurisdiction to investigate Senator De Lima's alleged involvement in the narcotics trade in the NBP."

"The jurisdiction belongs to DOJ, the prosecutorial agencies of government under the DOJ. An erroneous assumption of jurisdiction cannot justify an erratic assumption today. What recommendation will it make? There are already charges filed against De Lima before the DOJ because the DOJ is the proper forum for such prosecutorial investigation," Lagman said.

"It's so unfortunate that the Committee on Justice allowed itself to be used as a vehicle for a shame and vilification campaign," he said.










In a press conference on Saturday, Liberal Party bet Manuel “Mar” Roxas II said there are glaring differences between him and Duterte, particularly having a better track record than the Davao City mayor.

Authorities are processing several documents for the return of Kerwin Espinosa to the country after his arrest in Abu Dhabi.

However, as early as now, the DOJ is evaluating if he may be presented as a witness against Sen. Leila De Lima.

“That’s good. At least we could have an additional witness. If it will pass through the assessment of the Witness Protection Program (WPP), then we are going to offer immunity to Kerwin,” said Department of Justice (DOJ) secretary Vitaliano Aguirre.

The Albuera Police have filed charges against both Sen. De Lima and Espinosa for their alleged involvement in illegal drugs.

The DOJ’s suspicions are strong that De Lima and Espinosa are connected.

“They think they are very close. As a matter of fact, I have a picture of the two,” Sec. Aguirre said.

Sen. De Lima had earlier said that the photo in question might have been possibly taken during the campaign period when she had no control over who approached her.
However, Aguirre said, it is up to them to prove the connection between the two which is more than what the picture shows

Antonio Trillanes at ilang taga-Liberal Party ang umano'y nasa likod ng planong kudeta. Ayaw namang ibunyag ni Evasco kung sino ang nagbigay sa kanya ng impormasyon kaugnay sa planong kudeta laban sa Pangulo.

In Davao City, where the president served as mayor, a firecracker ban has long been enforced to avoid incidence of firecracker-related injuries and deaths especially during the year end celebrations.
During the campaign period, one of President Duterte’s proposed changes was the nationwide firecracker ban, but he said there are many things to consider.

“There will be loss of business, economic, whatever, social, everything. So I would need the Cabinet to decide. It will be a cabinet decision, “said Duterte.

Dieng said Duterte should exercise restraint in the use of language that could “exacerbate discrimination, hostility and violence and encourage the commission of criminal acts which, if widespread or systematic, could amount to crimes against humanity.”

The UN adviser said the Holocaust, under which an estimated six million Jews perished on Hitler’s orders, was “one of the darkest periods of the history of humankind and that any glorification of the cruel and criminal acts committed by those responsible was unacceptable and offensive.”

In his speech in Davao City after arriving from a two-day official visit to Vietnam, the President addressed his portrayal as a “cousin of Hitler” by critics.

Noting how Hitler ordered the massacre of millions of Jews, Duterte said: “Now there is three million, there’s a three million drug addict. There are. I’d be happy to slaughter them.”

“At least if Germany had Hitler, the Philippines would have you know…,” he added, pointing to himself.

“My victims, I would like to be all criminals to finish the problem of my country and save the next generation from perdition,” Duterte said.

Two UN-appointed human rights experts have earlier expressed concern about Duterte’s harsh crackdown on drug offenders, which has led to the deaths of more than 2,000 suspects since he started his term last June 30.

In addition to watching his words, Dieng asked Duterte to support the probe on the reported rise of extrajudicial killings under his watch.

 “You cannot be brighter than me. I will play with you in public.” This is what President Rodrigo Duterte has to say to the United States (US), the European Union (EU) and the United Nations (UN) a day after saying a formal invitation to the Philippines has been sent to them.

 “I will play with you in public. I will ask five questions that will humiliate you and 10 questions where you will agree with me,” he said in a speech at the 42nd Philippine Business Conference and Expo in Pasay City on Thursday. The President reiterated his earlier pronouncement that he be allowed to shoot questions to the UN, EU and the US, whom he invited to investigate the alleged extrajudicial killings under his administration.

He said that he would also prepare questions for his critics.

“Give me also the right to be heard so I will have to ask you questions after questioning me. Sige paikutin ko kayo sa kamay ko. I’lll play with you, I’m very sure they cannot be brighter than me. Maniwala kayo. Paikutin kita,” he said.

Senator Leila de Lima received a warm welcome from students, teachers and women’s groups today in a forum which centered on women’s life, dignity and human rights.

In her speech, de Lima decried the sexist remarks thrown at her by President Rodrigo Duterte.

She said the statements made by Pres. Duterte and the actions of his cohorts grossly violate her rights as a woman and as a human being.

“With no less than their leader calling me an immoral woman, a woman of the world who should be ashamed of herself and therefore should hang myself, while he himself confessed unfaithful, womanizer, proud womanizer. If that is not sexism, what is?” de Lima exclaimed.

“Hindi po ako ang protektor. Mayroon d’yan na tunay na protektor. But certainly not me! I have nothing to do with the drug trade except try to defeat and destroy the ones operating right inside the National Bilibid Prison. Lies! Lies! Lies!”

De Lima admitted she is not perfect and has committed mistakes in her personal life, but can never betray the country.

In lieu of what she is going through, she urged women to stand up for their rights and to always keep their dignity and integrity intact amid attempts to degrade the value of women in society.

“There is truth to the role of women as nurturers. We need to nurture our own dignity in order to win back our true democracy. What we have now is mobbed role and madness,” she said.

After the death of his friend and colleague Dick Israel this week, Robin Padilla took to Facebook to make a push for the legalization of medical marijuana in the Philippines.
The actor called Israel, who died on Tuesday after being paralyzed from stroke since 2010, "another victim of the medical marijuana oppression."
"Im sorry i failed you dearest friend, i really thought this government is already educated enough to legalize medical marijuana" Padilla wrote.
"Hypocrites are still under the banner of Big pharmaceutical companies."
He added that during Israel's illness, the stricken actor had asked for relief with medical marijuana.
"Hindi ko isinulat ito at pinost para sisihin ang gobyerno sa pagkamatay ng aking kaibigan kundi para ipaalam sa lahat na ang gamot na hinihingi sa akin ni dick israel ay medical marijuana at hindi ko naibigay sa kanya dahil BAWAL!!! Buhayin sa congreso ang #HB180" Padilla wrote.

Padilla is a staunch supporter of President Rodrigo Duterte, whose war against drugs is the centerpiece of his administration's platform. But Padilla defended his stance amid criticism from some netizens.
"Sa mga hindi nakakaintindi sa gobyerno.. ito po ang maliwanag na pagpapaliwanag, una si Mayor duterte is not against medical marijuana stick that to your thick skull," he said.
"pangalawa ang gobyerno ay hati sa tatlong sangay Executive kung saan andon ang Pangulo, legislative kung san andon ang senado at congreso, at ang judiciary kung san andon ang supreme court.. Hindi porket sinabing gobyerno ay si mayor na kaagad ang nasa isip ninyo. Magbasa basa nga kayo at gumamit ng internet ng tama para may dagdag kaalaman .. At lalong hindi recreational marijuana ang itinutulak ko kundi MEDICAL marijuana ... Buhayin sa congreso ang #HB180" he added.
Earlier this month, Padilla's nephew Mark Anthony Fernandez was arrested for marijuana possession. Fernandez had claimed to be using marijuana for medicinal benefits.
Describing Fernandez's plight, Padilla said "medical marijuana will be his contribution to the future... For now let us thank and praise God he is alive Alhamdulillah."

                                 Duterte signs EO on 25-year plan to eliminate poverty





President Rodrigo Duterte has signed Executive Order (EO) No. 5, which adopts "Ambisyon Natin 2040", the 25-year long-term vision of the National Economic and Development Authority (NEDA) to wipe out poverty and hunger in the country.

"The Philippine government hereby aims to triple real per capita incomes and eradicate hunger and poverty by 2040, if not sooner," the EO read.

The EO also seeks to identify a set of milestones that will guide the successive medium-term development plans of the Philippines.

Under the EO, four Philippine Development Plans (PDPs) will be crafted and implemented until 2040.

These PDPs are anchored on Ambisyon Natin 2040, which proposes that "By 2040, the Philippines shall be a prosperous, predominantly middle-class society where no one is poor. Our peoples will enjoy long and healthy lives, are smart and innovative, and will live in a high-trust society."

According to NEDA, this ensures sustainability and consistency of strategies, policies, programs and projects across political administrations.








 Justice Secretary Vitaliano Aguirre II said Friday they will consolidate the two drug trafficking complaints filed against Senator Leila De Lima and several individuals in relation to the illegal drug trade inside the New Bilibid Prison.

Filed separately by the Volunteers Against Crime and Corruption (VACC) and former National Bureau of Investigation (NBI) deputy directors Reynaldo Esmeralda and Ruel Lasala this week, the complaints accuse De Lima and several others of conspiracy to commit drug trade and selling dangerous drugs.

The offenses fall under Section 5 and Section 26 of the Comprehensive Dangerous Drugs Act (Republic Act 9165).
Aguirre said five prosecutors, whose names will be released in a department order to be issued later Friday, will be handling the complaints.

Asked if the complaints will be consolidated since both raised similar issues, Aguirre said: "Yes."

Apart from De Lima, also charged by the VACC were the following:

    former Justice Undersecretary Francisco Baraan III;
    former BuCor chief Franklin Bucayu;
    De Lima's former security aides Ronnie Dayan, Joenel Sanchez and Jose Adrian Dera alias Jad De Vera;
    Bucayu's staff and alleged bagman Col. Wilfredo Ely; and
    high profile inmate Jaybee Sebastian

The second complaint, which tagged De Lima as the "mother of all drug lords," only listed the senator and former Bureau of Corrections (BuCor) officer-in-charge Rafael Ragos as respondents.

Once the preliminary investigation is concluded, the justice department will forward its findings to the Office of the Ombudsman, the agency mandated to investigate and prosecute erring government officials and employees before the Sandiganbayan.



The NBI also has a pending fact finding investigation on the proliferation of illegal drugs inside the national penitentiary during De Lima's stint as justice chief for the purpose of filing charges before the Department of Justice.

De Lima has repeatedly denied the allegation that she tolerated drug syndicates inside the national penitentiary in exchange for funds to bankroll her senatorial campaign early this year.

The senator said the cases were meant to harass her due to her continued criticism of President Rodrigo Duterte's brutal war on drugs.
